These aren’t small numbers, so their resistance to assuming an unknown level of financial risk is warranted. Essentially, every time they release new capability, they face regulatory scrutiny and potential fines, creating a repeating high-stakes financial gamble. In many situations, users of this technology are also assuming risk, so it's important to be informed.


Technology Capabilities in the US vs. Other Countries

The US enjoys access to a range of advanced technologies that are not as readily available in other countries due to various regulatory and infrastructural challenges. Here are some key points to understand:

In 2013, 23andMe, a pioneer in personal genomics, faced a significant setback when the FDA ordered it to halt the marketing of its health-related genetic tests. This bold move by the FDA highlighted the agency's commitment to safeguarding public health, driven by concerns that consumers might misuse or misinterpret genetic information, leading to dangerous health decisions such as seeking unnecessary invasive surgery. AI Act: The EU has adopted the AI Act, which imposes strict regulations on AI applications based on their risk levels. High-risk AI systems, such as those used in critical infrastructure, education, and law enforcement, face stringent requirements for transparency, accountability, and safety. It's important to note that, even if you don't actively do business in the EU, any organization who creates an AI-generated output (e.g., a dataset), that is used by an EU citizen or business, is subject to their fines. Many expect this legislation to become the defacto AI standard around the globe.


NOTE: If you serve EU businesses or individuals, or you create AI-generated outputs such as datasets, that are used by EU businesses or individuals; you are subject to the EU AI Act. Further, you are expected to comply with its' provisions and have your personnel trained within 6 months of it being registered (expected due date is near the end 2024).
